Regulations Under the Legislation to Regulate Condo Managers Are Out For Consultation!

The Ministry of Government and Consumer Services has posted today a draft of the first set of proposed regulations to be adopted under the new Condo Management Services Act. This Act is the legislation which will regulate and provide for the licensing of Condo Managers in Ontario.

For those who want to have a look at what is being proposed:

For the time being, the Province’s press release indicates that the proposed regulations will focus on the following 2 key areas:

1.  Licensing & Transition, which will address the following points:
• Two-stage licensing (general and limited);
• Application requirements;
• Educational requirements;
• Conditions of a licence;
• Exemptions from licensing; and
• Transition.

2. Regulation of Licensees, which will address the following points:
• Content of licence;
• Proof of licence;
• Retention of business records;
• Transfer of client condominium corporation records
• Public information on licensees; and
• Complaints procedures.

The Ministry of Government and Consumer Services is inviting comments by February 6, 2017.  Comments can be sent to :

It is expected that these regulations will come into force on July 1st, 2017.

Additional regulation to come at a later date will include a proposed code of ethics and the appointment and processes for a discipline committee.  These proposed regulations will be available for public comments in early 2017 and are proposed to take effect in late 2017.
